Terms and Conditions for Registration of Classes

Interpretation

 In these Terms & Conditions, except where the context otherwise requires:

a.                   “Client”, “you”, or “your” means the individual(s) who has accepted or proposes to accept products or services by Joyous Learning;

b.                   “Contract” shall mean collectively these Terms & Conditions, the Registration Form and the Joyous Learning Privacy Policy and such other policies, guidelines, codes of conduct and/or regulations of Joyous Learning as are informed and provided to the Client, Parents and Student (and as amended, supplemented and varied) from time to time;

c.                   “Regular Programmes” mean all regular classes, courses, workshops and programmes developed, offered and conducted by Joyous Learning and/or its Staff for the Student during each Term other than the Holiday Programmes or Special Programmes;

d.                   “Course Materials” means all materials, documents, worksheets, or instruments (whether in physical or digital copy) used, distributed or otherwise circulated in relation to the Student’s enrolment with Joyous Learning under the Regular Programmes, Holiday Programmes or Special Programmes, including but not limited to all audio or video recordings of classes, and quizzes/tests and activities held in respect thereof;

e.                   “Class” or “Classes” whether or not such term has been capitalised, mean all classes, courses, workshops and programmes and conducted by Joyous Learning and/or its Staff for the Student, in respect of the Regular Programmes, Holiday Programmes or Special Programmes.

 In these Terms & Conditions, except where the context otherwise requires:

a.                   “Client”, “you”, or “your” means the individual(s) who has accepted or proposes to accept products or services by Joyous Learning;

b.                   “Contract” shall mean collectively these Terms & Conditions, the Registration Form and the Joyous Learning Privacy Policy and such other policies, guidelines, codes of conduct and/or regulations of Joyous Learning as are informed and provided to the Client, Parents and Student (and as amended, supplemented and varied) from time to time;

c.                   “Regular Programmes” mean all regular classes, courses, workshops and programmes developed, offered and conducted by Joyous Learning and/or its Staff for the Student during each Term other than the Holiday Programmes or Special Programmes;

d.                   “Course Materials” means all materials, documents, worksheets, or instruments (whether in physical or digital copy) used, distributed or otherwise circulated in relation to the Student’s enrolment with Joyous Learning under the Regular Programmes, Holiday Programmes or Special Programmes, including but not limited to all audio or video recordings of classes, and quizzes/tests and activities held in respect thereof;

e.                   “Class” or “Classes” whether or not such term has been capitalised, mean all classes, courses, workshops and programmes and conducted by Joyous Learning and/or its Staff for the Student, in respect of the Core Programmes, Holiday Programmes or Special Programmes;

f.                   “Holiday Programmes” and “Special Programmes” mean all classes, courses, workshops and programmes developed, offered and conducted by Joyous Learning and/or its Staff for the Student, independent and outside of the Core Programmes;

g.                   “Infectious Disease” means the definition assigned to it under the Infectious Disease Act (Chapter 137) of Singapore;

h.                   “Parents” mean the parents of the Student and any person or guardian who has or has accepted parental or legal responsibility for the Student. Parents are responsible, individually and jointly, for complying with their obligations under these Terms and Conditions;

i.                   “Personal Data” means the definition assigned to it under the Personal Data Protection Act 2012, and shall include any data about you, the Parents or Student, who can be identified from that data and/or other information to which Joyous Learning has or is likely to have access to.

j.                   “Programmes” whether or not such term has been capitalised, mean the Regular Programmes, Special Programmes and Holiday Programmes, and “Programme” shall mean any one of them;

k.                   “Registration Form” refers to Joyous Learning’s registration form pursuant to which the Student is enrolled in Joyous Learning;

l.                   “Services” means the classes, courses, workshops and programmes developed, offered and conducted by Joyous Learning and/or its Staff for the Student under the Contract, and shall include the Regular Programmes, Special Programmes and Holiday Programmes;

m.                   “Staff” means any officer, teacher (whether permanent or temporary), employee, agent, service provider, representative or contractor of Joyous Learning, whether located in Singapore or outside of Singapore;

n.                   “Student” means the individual(s) who is the recipient of Services provided by Joyous Learning;

o.                   “Term” means each period of the academic year during which Joyous Learning regularly conducts classes;

p.                   “Terms & Conditions” mean the terms and conditions contained herein and applicable to the provision of all Services;

q.                   “Joyous Learning”, “we”, “us” or “our” means Joyous Learning Academy Pte Ltd and its affiliates.

2.                   These Terms & Conditions apply to the provision of all Services by Joyous Learning to the Student upon the engagement of the Client, and are to be complied with by the Client, Parents and Student at all times and are deemed incorporated in the engagement of Joyous Learning and the provision of the Services. Joyous Learning may revise these Terms & Conditions and the Client, Parent and Student shall continue to be subject to such Terms & Conditions as amended, modified and/or substituted by Joyous Learning from time to time and published on Joyous Learning’s website at www.joyouslearning.com.sg. The utilisation and continued utilisation (upon an amendment, modification and/or substitution of the Terms & Conditions) of the Services by the Student shall be deemed acceptance of these Terms and Conditions by the Client, Parents and Student whether or not the Terms & Conditions (and any subsequent amendment, modification and/or substitution) are signed and returned to Joyous Learning by the Client.

3.                   The headings in these Terms & Conditions are for convenience only and shall not affect the interpretation hereof.

Conditions of Enrolment

  1. A one-time non-refundable registration fee of $50 is chargeable for new registrations. A re-enrolment after a withdrawal will be considered a new registration.
  2. A deposit of $150 is chargeable for every programme registered. This deposit will be used to partially offset fees for the final month of enrolment or for any outstanding payments due at the time of withdrawal or completion of programme.
  3. Withdrawal can only be effected upon completion of the last lesson of a calendar month. If a notice for withdrawal is submitted before the first lesson of a particular calendar month, the withdrawal will be effected upon completion of the last lesson of the same calendar month. If a notice for withdrawal is submitted after the first lesson of that calendar month has commenced, the withdrawal will be effected upon completion of the last lesson of the following calendar month. In the event where the notice period is not served to completion, there will be a forfeiture of the deposit.
  4. Transfers to another class timing for the same programme, upon request and approval, can only be effected at the beginning of the following month.
  5. There will be replacement lessons for classes that fall on public holidays. The schedule for replacement lessons for affected classes will be provided upon commencement of the first lesson. There will be no refund of fees in the event the student is unable to attend the replacement lessons.
  6. If a Student is unable to attend a lesson because of valid reasons such as school activity or because he or she is unwell, a replacement lesson may be arranged for within the same week subject to class and seat availability. Requests for replacement lessons have to be accompanied by submission of relevant documentary proof such as official school letter or medical certificate. Replacement lessons may be requested for only once a month. There will be no refund or proration of programme fees if a replacement lesson cannot be arranged.
  7. For Clients paying by GIRO, deductions for any outstanding payments will take place on the 1st day and 15th day of every month. If any of those dates falls on a Saturday, Sunday or bank holiday, the deduction will be made on the next working day.
  8. Joyous Learning reserves the right to manage the scheduling of its classes at its sole discretion. This includes, but is not limited to, the changing of class timings, discontinuing a programme or reassignment of teachers.
  9. Joyous Learning will take all necessary safety measures and act in a responsible manner to ensure the safety of each student within its premises. Notwithstanding that, no employee and/or agent of Joyous Learning may be held responsible or liable for any injury, loss of property or other damage that may be cause to, or suffered or sustained by any student within its premises.
  10. Joyous Learning owns the intellectual property and licensing rights subsisting in all Course Materials provided to the student.
  11. Any unauthorised use, sharing, sale, copying, recording, reproduction or disclosure of the Course Materials (or any part thereof) or Joyous Learning’s intellectual property rights, including any unauthorised use of any trademark owned or used by Joyous Learning is stricted prohibited.
  12. The Client, Parents and Student consent to Joyous Learning using the Student’s name, work, photographs, academic records, photographs, audio/visual recordings and other material for promotional and other purposes such as publicising Joyous Learning and its students’ accomplishments to internal and external audiences, including in print and online, whether during the course of the Student’s enrolment with Joyous Learning or thereafter.
  13. The Client, Parents and Student consent to the collection, use and disclosure of their Personal Data for the registration and continued enrolment of the Student in Joyous Learning, and such other purposes as described in the Joyous Learning Privacy Policy.
